SALES PROMOTION MECHANICS, TERMS & CONDITIONS

  1. Fairmode Inc. (henceforth referred to as the “Promoter”) is the Sponsor and promoter of this promotion (“Promotion”).
  2. The promotion period shall be from 13 September 2013 to 15 December 2013 (both days inclusive) (the “Promotion Period”).
  3. Customers will be eligible for this Promotion and automatically enrolled into one or more lucky regular and special draws below upon fulfilling the eligibility requirements below (“Eligibility Requirements”):
    1. The purchaser must register an eBay account at http://www.eBay.ph, which will entitle him to an eBay user ID;
    2. The purchaser meets the following requirements:

    Rank as one of the Top 1,000 buyers (based on the total number of completed purchases on http://www.eBay.ph) during the calendar month.**
    Year-End Grand Prize Car Draw Purchase any 1 item with a minimum value of PHP 99 via http://www.eBay.ph during the Promotion Period.*

    This qualifies the purchaser only for the specific monthly draw period, and for the year-end grand draws.
    Special Year-End Car Draw for the Top 1,000 Buyers for the duration of the Promotion Purchase any 1 item with a minimum value of PHP 99 via http://www.eBay.ph during the Promotion Period;* and

    Rank as one of the Top 1,000 buyers (based on the total number of completed purchases on http://www.eBay.ph) during the entire duration of the Promotion Period. **

    *To be eligible, the purchaser must be a successful purchaser. A successful purchaser is a purchaser who has not cancelled or revoked his or her completed purchase of his/her item(s) during the duration of the Promotion Period, the period of redemption and thereafter.

    **A purchase is completed when a purchaser receives email confirmation from eBay that a purchase has been completed.

    Ranking the Top 1000 Buyers. All purchasers who have made one or more qualifying purchases via http://www.eBay.ph (either in a specific month for the Special Monthly Draw, or during the entire duration of the Promotion Period for the Special Year-End Car Draw) will be ranked based on the number of completed purchases during the applicable time period, with the Top 1,000 buyers being determined starting with the buyer who has made the most number of qualifying purchases.

  4. Each purchase by an eligible purchaser entitles an eligible purchaser to one qualifying entry in the database from which the winners shall be chosen randomly.

    Accordingly, multiple purchases (i.e. the purchase of more than 1 item with a minimum value of PHP 99 via a href="http://www.eBay.ph">http://www.eBay.ph during the Promotion Period) by a single customer will increase his or her chances of winning in the special monthly and year-end draws.

    For all draws, there is no limit on the number of times or prizes that a participant can win per draw and across draws.

  5. The Promoter shall, by way of a computer program, identify the winners for the monthly and year-end draws at 4:00 p.m. on 14 October 2013, 14 November 2013, 14 December 2013 and 14 January 2014, each of whom will be awarded the corresponding prize(s) set out below. The venue for determination of winners shall be the Promoter’s office at 3270-C, Armstrong Avenue, Merville Access Road, Brgy. Kalayaan, Pasay City 1300, Philippines, 207. For the avoidance of doubt, the Promoter shall be wholly responsible for selecting the winners.

  6. All winners shall be announced on eBay Philippines (http://www.eBay.ph) and notified by email and by registered mail or courier, at the address provided by the winner when he or she registered an eBay account, on each of the draw dates set out in paragraph 5 above. Cash prizes shall be awarded via winners’ PayPal accounts or via direct bank transfer (at winners’ option), while winners of the Xend Express Shipping Voucher will have their voucher mailed to them. The winners of the cash prizes and vouchers may redeem their prizes by sending an e-mail notice to the Sponsor acknowledging receipt of the notice referred to in this paragraph and indicating therein the mode of redemption preferred (PayPal accounts or via direct bank transfer). The winners of the cash prizes and vouchers shall have 60 days to redeem their prizes from date of receipt of the notice.
  7. The winner(s) of the Mitsubishi Mirage(s) awarded as part of the Year-End Grand Prize Car Draws shall have 60 days from the date of notification of winners within which to claim their prizes. The winners shall redeem their prizes by contacting the Promoter through the contact details provided in the notice within such period for the schedule of the redemption of their prize(s), and must personally claim their prizes within 60 calendar days from the date of receipt of the notice. The Promoter may forfeit the prize(s) subject to applicable rules and regulations of the Department and Trade and Industry.
  8. All prizes awarded as part of this Promotion are non-transferable and non-exchangeable. The winners shall pay for the applicable taxes imposed on the prizes, which shall be 20% of the value of any prizes that exceed PHP10,000. The respective winners of the Mitsubishi Mirages shall each shoulder the payment of the applicable taxes and such other costs that are necessary to register such vehicles in the name of the winners.
  9. By entering this Promotion, entrants agree to be bound by these Mechanics, Terms and Conditions and consent to the use of their names, photograph and/or image for publicity purposes in all media carried out by the Promoter, without payment or compensation.
  10. The Promoter shall require each winner to provide proof of identity and/or eligibility (if required) in order to claim a prize, i.e., presentation of a government-issued identification card. In the event that a winner cannot provide a valid proof of identification as specified in this mechanics, terms and conditions within the redemption period, the Promoter has the right to forfeit the prize from the winner.
  11. As the Promoter is not the manufacturer or the supplier of the prizes provided as part of this Promotion, warranty claims on the prizes shall be directed to the manufacturer or supplier, as may be applicable under current Philippine laws, rules and regulations.
  12. These Mechanics, Terms and Conditions and any dispute arising out of or in connection with these Terms and Conditions shall be governed by and construed in accordance with the laws of the Philippines.
