Who can enter?
     
1. Information about the prizes and how to enter forms part of these Terms and Conditions for the eBay.ph “Treasure Hunt Instant Win” Promotion (Promotion).  Entry into the Promotion is deemed acceptance of these Terms and Conditions.  Entries not in accordance with these Terms and Conditions are ineligible.
   
2. Entry is open to all residents of the Philippines over the age of 18 years.  Employees of the Promoter, its associated companies, suppliers, distributors, agents and their immediate family members, and persons whose eBay or Paypal accounts have been temporarily or indefinitely suspended or made inactive by the Promoter (as defined in clause 30) during the Promotion Period (as defined in clause 8), are not eligible to enter the Promotion.
   
3. Entrants are responsible for ensuring that all their contact details registered with or submitted to the Promoter are correct.  Entrants will forfeit their right to claim the Prize (as defined in clause 13) in the event that their contact details are inaccurate or wrong.  Members of eBay may check or update their contact information with eBay by visiting the Personal Information section of My eBay at https://www.ebay.ph.

To qualify for entry into this Promotion, you must at the time of entry:

  1. be validly registered as a member of https://www.ebay.ph (in accordance with all applicable Philippine terms and conditions, policies and your User Agreement with eBay); and

  2. have a valid and verified Paypal account in good standing, with current contact information throughout the Promotion Period.  In order for an account to be deemed in Good Standing as that term is used herein, the account must not have a hold status and/or be suspended or past due as of and from the starting date of the Promotion Period.  Please visit https://www.paypal.com to learn more about Paypal, becoming a Paypal user and the terms and conditions that will apply in that regard.
How do you enter and take part in the Promotion?

To enter this Promotion, during the Promotion Period you must:

  1. login to your eBay user account at https://www.ebay.ph;

  2. visit https://pages.ebay.ph/treasurehunt/getclues.html (“Get Clues" Page) and read the daily clues that may lead you to a hidden treasure, i.e. a listing within https://www.ebay.com or https://www.ebay.ph which if you click on and open, will entitle you to win a Prize; and

  3. try to solve the relevant puzzle that each clue is made in respect of. Use the search function and search for listings that may contain the hidden treasure, based on the daily clues and keywords associated with the possible solution of such clues. If you find the listing with the treasure, click the “Buy It Now” button and you will have won the Prize.
   
6. Each eBay member will only be entitled to win one (1) Prize per during the Promotion Period.
   
7. All eBay members must conform to eBay’s policies and user agreements applicable during the Promotion Period.
 
Promotion Period
   
8. This Promotion commences at 00:00:01 Philippine Standard Time, i.e. GMT + 8 hours (PST) on 19 May 2008 and closes on 23:59:59 PST on 30 May 2008 (Promotion Period).
   
9. For every day during the Promotion Period except for the days of the weekend (i.e. 24 and 25 May 2008), there will be 2 clues released on the “Get Clues” Page which can be used to search for and find the hidden treasure. For the avoidance of doubt, on the days of the weekend no clues will be released and hence no corresponding treasures and Prizes will be available for those days.  
   
10. All the required steps that you must take in order to enter this Promotion as set out in these Terms and Conditions must be confirmed as having been done by the Promoter by the end of the Promotion Period. 
 
How will the Winner be selected?
   
11. The first person who searches correctly for, locates and claims the treasure hidden in a listing on either https://www.ebay.com or https://www.ebay.ph, based on the appropriate clue from the “Get Clues” Page, will be the winner of that treasure (Winner).
   
12. There will be up to 20 Winners in this Promotion in total.
 
Prize
   
13. The total prize pool for this promotion is valued at 180,000 PHP.
   
14. Each of the prizes (Prizes) shall be 9,000 PHP of PayPal credit and will be awarded to each of the Winners.
   
15. Winners must have a valid registered PayPal account in order to receive their Prize.
   
16. Each Prize will be transferred to each Winner’s valid registered PayPal account within 45 days of the Winners being determined.  In order for the Prize to be transferred into a Winner’s PayPal account, the Winner must actively accept the transfer. 
   
17. Entrants are responsible for ensuring that all their contact details registered with eBay and PayPal are correct. Entrants will forfeit their right to claim the Prize in the event that their contact details are inaccurate or wrong or they have an invalid eBay or PayPal account. Entrants may check or update their contact information by visiting the Profile tab on the PayPal site at https://www.paypal.com or the My Account section on the eBay site at https://www.ebay.ph. 
   
18. Winners who reject the credit will be deemed to have rejected the Prize and the Prize will be forfeited.
   
19. The Promoter retains the right to substitute the Prize with a prize of equal or greater value, subject to any approvals necessary.
   
20. No costs or expenses, other than those expressly set out in these Terms and Conditions will be included in the Prize and all costs and expenses other than those expressly included within the Prize in these Terms and Conditions are the responsibility of the Winner.
   
21. The Prize is not transferable or exchangeable.
 
How will the Winners be notified and announced?
   
22. A Winner will know he has won a Prize when he has located the listing with the hidden treasure and has actively claimed that Prize by clicking the “Buy It Now” button. 
   
23. During the Promotion Period, each time a clue relating to a puzzle is solved, the treasure is found and the Prize is claimed, the Promoter will publish notification that the particular treasure has been found as well as publish the Winner’s first initial, surname and truncated form of username (e.g. a**b) on the announcement board of https://www.ebay.ph. 
 
Privacy Policy
   
24. All personal information will be held and dealt with in accordance with the Privacy Policy of the Promoter which is available on the eBay website (https://pages.ebay.ph/help/policies/privacy-policy.html).
   
25. Each entrant consents to the Promoter and its agents collecting the information provided in their entry in order to conduct the Promotion.  Neither the Promoter nor its agents will use the information collected in the course of the Promotion for any marketing purposes, other than in connection with the Promotion.  An entrant may access and correct any personal information held by the Promoter in relation to that entrant, upon request to the Promoter.
 
General
   
26. The Promoter’s decisions with regard to the selection of the Winners are final, and no correspondence will be entered into, including in the event of a dispute.
   
27. The Promoter is not liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with participating in this Promotion or receiving, taking or using the Prize, except for any liability which cannot be excluded by law.  Any tax liability arising as a result of receiving, taking or using the Prize is the responsibility of the Winner.
   
28. Entries are deemed to be received at the time of receipt into the Promoter's database.  The Promoter is not responsible for entries not received or the receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission.  The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, lines, servers, telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person's handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
   
29. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its sole discretion to modify the terms of the Promotion including the Prize and these Terms and Conditions, subject to approval from any relevant regulatory authorities. 
   
30. The Promoter is eBay International AG of Helvetiastrasse 15/17 BERN CH-3005 Switzerland (Promoter or eBay).
